Energized Work Refusal and Escalation
Purpose
The permit process decides whether energized work is justified. This procedure covers the far more common case, which is that it is not, and somebody standing in front of the technician wants it done anyway. That somebody is usually a facility manager losing a shift, sometimes a general contractor with a schedule, and occasionally the technician's own dispatcher.
A refusal that lives only in a technician's judgment fails predictably: it holds on the first call, holds on the second, and folds on the third, because the tech is alone, the customer is angry, and no piece of paper says the tech is right. A refusal that lives in a procedure holds every time, because the tech is not the one refusing. The shop is, and the tech's job is to say so, hand off, and leave. The second thing this owns is the direction nobody writes down: what a technician does when the pressure comes from inside the shop.
Scope
Covers the refusal and escalation for any work that would put a person inside the restricted approach boundary on exposed energized parts at 50 V or more without an approved permit, and the handling of customer or internal pressure that follows. Covers the words used, the escalation clock, the record and the return visit.
Does not cover the justification test itself or the permit form, which the energized work permit SOP owns and which this procedure invokes by name. Does not cover the isolation sequence performed once a shutdown is granted, or PPE selection. Anything touching your own liability, your customer contract or an employment dispute is a question for your own attorney; what follows is the operational half.

Procedure
Stop the work where it stands and secure what is already open before any conversation starts. Acceptance: no cover or deadfront is left off, every fastener is back in, and the tech is standing outside the arc flash boundary before speaking. Wrong looks like a debate held with a panel open and the customer three feet away. Stop rule: nothing resumes on that equipment until the escalation resolves, including "just to show you what I mean." Hazard: an open panel with nobody assigned to it is the real danger in this whole procedure, because the people now gathering around it are in street clothes and are not qualified persons.
State the refusal once, in one sentence, on the shop's authority rather than your own. Acceptance: the sentence names the requirement, not a preference. Something close to: "Our rule, and the OSHA rule at 29 CFR 1910.333(a)(1), is that this gets de-energized unless de-energizing creates a bigger hazard or is infeasible because of how the equipment is built, and neither is true here." Wrong looks like "I am not comfortable with that," which invites negotiation about the tech's comfort. Stop rule: say it once and stop talking; repeating it three different ways reads as searching for a version the customer will accept. Hazard: none at this step, it is a sentence said standing outside the boundary, which is why step 1 comes first.
Offer the alternative that makes a shutdown feasible, with an actual number attached. Acceptance: at least one concrete option named with a time, a duration or a piece of equipment: an after-hours window with a stated start time, a temporary feed, a load transfer, a rental bypass, or a partial shutdown of one panel section rather than the building. Wrong looks like "call us when you can shut it down," which hands the customer a problem instead of a plan. Stop rule: if no alternative exists, say so plainly rather than inventing one; a shop that promises a bypass it cannot source loses the next argument too. Hazard: none at this step; what it manages is the tech being talked into the work for lack of anything else to say.
Escalate by phone to the supervising master within 15 minutes, from the site, with the customer present. Acceptance: the call is placed, connected and put on speaker where the customer can hear it, and the supervising master states the shop's position directly to the customer. Wrong looks like the tech texting the office and waiting, which leaves them alone in the room with the pressure. Stop rule: if no approver is reachable inside 15 minutes, the answer stays no by default and the tech packs up; an unreachable approver never becomes an approval. Hazard: none at this step, though note that a customer who becomes hostile during it changes the situation, which step 5 handles.
Set a hard boundary if the pressure continues, and leave. Acceptance: one closing sentence stating that the shop will return when the equipment can be de-energized, then tools packed and the tech off site, with the office told the tech is leaving before they walk out. Wrong looks like staying to keep the peace, which is how a tech ends up doing the work at the end of an hour of pressure. Stop rule: any threat, any physical intimidation, any instruction to work energized from someone who will not put it in writing, and the tech leaves immediately without further discussion and calls the office from the vehicle. Hazard: this is the step where a person, not the equipment, is the hazard, and the control is distance; do not stand between the customer and the door, and do not go back for tools left inside until someone else is with you.
Where the pressure is coming from inside the shop, use the same procedure upward. Acceptance: the refusal goes to the owner in writing the same day, stating the task, the hazard and the requirement, and the owner answers in writing within one business day. Wrong looks like a verbal disagreement in a parking lot with no record. Stop rule: an instruction to perform energized work without an approved permit is refused whoever gives it, and refused in writing. OSHA's narrow right-to-refuse provision at 29 CFR 1977.12(b)(2) requires a reasonable apprehension of death or serious injury, no reasonable alternative, too little time to get the hazard corrected through normal channels, and that the employee asked the employer for a correction and did not get one; section 11(c) of the OSH Act, which covers retaliation, requires a complaint be filed with OSHA within 30 days of the retaliation. Whether a specific refusal is protected is a question for your own attorney, not one to settle in a truck. Hazard: none at this step, it is written correspondence, and writing it is what makes the rest work.
Return only when the condition that forced the refusal is gone, and prove it before and after. Acceptance: the shutdown window is confirmed in writing by someone with authority to grant it, an electrically safe work condition is established and proved live-dead-live per NFPA 70E's proving sequence in the edition your program names, and every protective device disturbed is verified working before the space is handed back. Wrong looks like returning on a verbal promise and meeting the same manager and the same answer. Stop rule: no written shutdown authority, no return visit; the ticket stays open at the office rather than being retried in the field. Hazard: restoring power is when a fault nobody found announces itself, so stand to the hinge side rather than square in front of the panel, and confirm the GFCI or AFCI protection on any disturbed circuit trips and resets on its test button before the work is called complete.
The record this produces
One refusal entry on the ticket, written on site rather than that evening. Fields: date and time, equipment ID and location, who asked for energized work and their exact words in quotation marks, the requirement cited, the alternatives offered with their numbers, the escalation call times and who answered, and whether the tech left or the customer accepted.
The dispatcher reads it before the next visit to that address so nobody walks in blind. The supervising master reads all refusals monthly, because a site producing repeated refusals needs a shutdown negotiated at the account level or a temporary feed quoted, not a braver technician sent next time. The owner reads the internal-pressure entries specifically, because those describe the shop rather than the customer.
One call, run
A small restaurant, mid-service. The walk-in cooler's dedicated circuit is tripping. The distribution panel also feeds the kitchen line, and the manager will not drop the panel until close, five hours out.
Step 1: the deadfront is already off from the initial look. It goes back on, all six fasteners, before anything is said. The tech steps out of the marked boundary and then starts the conversation.
Step 2: one sentence, delivered once, naming 29 CFR 1910.333(a)(1) and the two conditions. The manager's answer, recorded verbatim on the ticket, is "we cannot lose the line during dinner service."
Step 3: three alternatives, each with a number. An after-hours return at 10:30 p.m. that night. A partial shutdown of the panel section feeding the cooler only, which the tech checks and rules out because the section shares the busbar with no separate means. A temporary cord feed to the cooler while the panel is dropped, which needs a 20 A circuit within reach, and there is one on the opposite wall. Two live options remain and the third is ruled out with a reason rather than a shrug. Note what is not on the list: cost, which neither the OSHA paragraph nor the shop's permit test recognizes as a condition.
Step 4 fails. The supervising master does not answer the first call, or a second call eight minutes later. At 15 minutes the stop rule fires: the answer stays no, and the tech neither waits longer nor decides alone. This is the failure worth studying, because the tempting reading is that an unreachable approver leaves the decision to the tech. The procedure says the opposite, precisely because the tech under pressure is the person least able to make it.
Step 5: closing sentence, tools packed, off site inside ten minutes, office called from the vehicle. No hostility, so the threat clause did not fire.
The ticket records: refusal at 6:42 p.m., escalation attempted at 6:44 and again at 6:52, no answer either time, departure at 6:58. The 15-minute escalation window ran out at 6:57 with no approver reached, so the departure a minute later is on the rule rather than early.
Step 7 runs the following night. The manager confirms the 10:30 p.m. window by text, which is the written authority the acceptance requires. The panel is isolated, proved live-dead-live against a known source before and after, the failed breaker replaced, and on restoration the AFCI on the disturbed adjacent circuit trips and resets on its test button before the kitchen is handed back.
