Knowing When to Refer to a Licensed Trade
Purpose
A handyman shop gets asked to do gated work every week, usually by a customer who does not know it is gated and often as the fourth item on a list of four. The test that matters is not whether the tech can do it. It is whether the ACT is one the jurisdiction reserves to a licensed trade, or requires a permit for, and that question has an answer independent of how the tech feels about the work.
This procedure checks every item on a work order against a written gate before a tool comes out, answers the license question and the permit question separately because they are two different gates, and keeps the shop doing and getting paid for the part it is allowed to do.
Scope
Covers deciding, on site or at booking, whether the shop performs an item itself, refers it, or performs a bounded portion of it: electrical, plumbing, gas, mechanical, structural, roofing and any act your state or local authority licenses or permits.
Explicitly not covered:
- Pricing and authorizing the referred work, owned by the work beyond scope procedure.
- What to do with a condition you discovered mid-repair, owned by the hidden damage procedure. This one runs on a REQUEST; that one runs on a FINDING.
- Pre-1978 coated surfaces, which have their own federal gate and their own procedure.
- Whether your business license, insurance or bond covers a given act. That is a question for your own agent and attorney, not for a field procedure.

The procedure
Run the immediate-hazard override before anything about licensing. A gas odor means everybody leaves the building at once, no switch touched, no light and no phone used inside, and the utility called from outside. Water at an energized panel or standing water around energized equipment means nobody approaches it, the customer is kept back, and the utility or an electrician is called. Scorched conductors, a melted device or a hot panel cover means the circuit is opened at the panel if that can be done without standing in water, and the work goes to an electrician. Acceptance: the hazard action taken and the customer told, before any conversation about scope. Stop rule: any of the above ends this procedure at the referral rather than continuing through the gates. Hazard: the referral itself is not a control, so the immediate action comes first every time.
Mark every item on the work order against the shop's written trade-gate list before a tool comes out. Acceptance: each item marked shop, gated or unknown, in writing, with the gate applied to the ACT rather than to its difficulty. Typical gated acts, which your own list must confirm for your jurisdiction: extending or adding a branch circuit, replacing a panel or a breaker, altering gas piping, altering water supply or drain, waste and vent piping beyond the fixture connection, replacing a water heater, structural alteration, and roof covering replacement. One gate is federal and does not vary: opening a sealed refrigerant circuit on a stationary appliance requires EPA Section 608 certification under 40 CFR Part 82 Subpart F, and the same act on a motor vehicle air conditioning circuit is Section 609 under Subpart B instead. Wrong looks like a tech deciding by confidence, which produces a different answer from every tech. Stop rule: unknown is treated as gated until the office confirms otherwise. Hazard: none at this step, it is paperwork done at the truck.
Answer the permit question separately, because a permit gate can catch work no license gate touches. Acceptance: a yes or no on whether the authority having jurisdiction requires a permit for this act, with the source recorded, meaning the department's own published list or a logged call with its date and the name of who answered. Wrong looks like assuming no permit because the job is small or the last three like it did not need one; permit triggers move with each code cycle. Stop rule: permit required and not issued means the work does not start, whoever offers to pull it later. Hazard: none at this step; it is separate from step 2 because a permitted act performed without the permit is a violation even when the person doing it holds the right license.
Check whether a minor-work exemption applies, and check who it applies to. Many states exempt minor repair work below a stated value ceiling from contractor licensing, and the ceiling, the trades it reaches and whether labor and materials both count all vary by state, so the source is your own state contractor board's current page. The gating condition matters more than the number: these exemptions commonly do NOT reach electrical, plumbing, gas or mechanical acts even where they do reach general repair, and they are usually written per project rather than per visit. Acceptance: the exemption's applicability written on the ticket with the source and date checked. Stop rule: an exemption you cannot confirm today is not relied on today. Hazard: none at this step; whether a given exemption covers your specific arrangement is a question for your own attorney rather than a field call.
Say the referral to the customer as a fact about the work, and hand them a path. Acceptance: the reason stated as a license or permit fact, what the shop CAN do today named specifically, and the referral named as a trade rather than left vague. A workable line: "Swapping that fixture is ours. Running a new circuit to the garage is licensed electrical work here, so that one goes to an electrician, and I can have our office send you two names today." Wrong looks like "I'm not allowed to touch that" with no alternative, which sends the customer to whoever answers the phone next. Stop rule: a customer who presses after two plain refusals gets the lead on the phone from the site, and the tech does not negotiate. Hazard: none at this step; the pressure the conversation carries is why the words are written down in advance.
Do the shop's portion and draw the boundary physically, not just verbally. Acceptance: the ungated items completed, and the boundary written as a physical interface, for example the shop sets the vanity and connects the trap to an existing stub while the rough-in stays with the plumber. The failure this prevents has one shape: the tech who does everything except the last connection, then makes it because it is only two minutes. Wrong looks like leaving a gated system partly assembled so the next trade cannot tell what was done. Stop rule: any item whose completion requires crossing the boundary stops at the boundary and becomes an open item. Hazard: the ungated portion still carries its own risks, so before a fixture box is opened the branch is opened at the breaker and proven dead live-dead-live: prove the tester on a known live source, test every conductor and the box, then prove the tester on that live source again, so a tester that failed mid-check cannot read as a dead circuit. That sequence is NFPA 70E-2021, 120.5; the duty to work de-energized is 29 CFR 1910.333(b)(2). A supply is isolated at the stop and the line drained before a connection is broken.
Restore what you isolated, log the referral, and close the loop with a date. Acceptance: every breaker, stop or valve you operated during the assessment returned to its normal state and proven at a fixture or device you did not work on; the referral logged with the trade, the name given, the time, and who is calling whom; and a follow-up date on the calendar before the tech leaves. Wrong looks like a referral spoken aloud and never written, which the office cannot follow up. Stop rule: an open item leaving the site without a date gets the lead on the phone before the tech drives away. Hazard: closing a breaker or opening a stop re-energizes and re-pressurizes everything you have been working around, so warn the occupant first, stand to the hinge side of the panel rather than square in front of it, and keep hands clear of the fixture while the line refills.
The record this produces
A gate block on the work order, which the office reads when the customer calls back and the shop reads if anyone asks why an item was declined:
- Per item: the item, its mark of shop, gated or unknown, and the gate that produced the mark.
- Permit: required or not, with the source and the date it was checked.
- Exemption: whether one was relied on, with the source and date.
- Customer conversation: what was said and what alternative was offered.
- Boundary: where the shop's work stopped, described as a physical interface.
- Referral and restoration: trade, name given, who calls whom, follow-up date, and every device returned to normal and proven.
Worked pass: four-item list, 1988 house, 3.0 hour block
Items: replace a bathroom vanity light on its existing box; add a receptacle in the garage; replace a leaking angle stop under a kitchen sink; replace a bathroom exhaust fan dumping into the attic and re-route it to a new roof cap.
Step 1: nothing on the immediate-hazard override. No gas odor, no water at a panel, no scorching at the fan housing.
Step 2: marked against the list. Item 1 shop, as a like-for-like luminaire swap on an existing outlet box. Item 2 gated, because it extends a branch circuit. Item 3 shop, as a fixture connection at an existing stub. Item 4 marked unknown and therefore treated as gated, because it combines an electrical connection with a new roof penetration.
Step 3 FAILED on item 4 and took its stop rule. The tech called the building department, logged the call with the date and the name of who answered, and was told the new exhaust termination requires a mechanical permit. The answer was yes with no permit issued, so item 4 did not start. The old fan was left in place and running, since removing it would have left an unpermitted opening and a bathroom with no exhaust.
Step 4: no minor-work exemption relied on. The two ungated items are ordinary repair rather than electrical or plumbing alteration, so nothing hung on an exemption.
Step 5: told to the customer as two sentences, one for the electrical gate on item 2 and one for the permit gate on item 4, with the office to send names for both. The customer pushed once on item 2, then accepted.
Step 6: items 1 and 3 completed, 1.4 hours. Breaker opened and the branch proven dead live-dead-live before the fixture box was opened, supply stop closed and the line drained into a bucket before the angle stop came off. Boundary written as "existing box, existing stub" so the electrician and the plumber can see where the shop stopped.
Step 7: the branch breaker closed and proven at a hall receptacle the shop never worked on, the supply stop reopened and the connection watched dry for two minutes. Referral logged for both gated items with a callback date. Visit closed at 1.9 hours of the 3.0 hour block, releasing 1.1 hours.
Of the four items, two cleared to the shop, one was gated on license and one on permit, and the item that stopped the work stopped on the permit gate.
