Paint Waste and Washout Disposal Standard

Purpose

Get every gallon of waste a paint job produces into the right container and out to the right place, with a record that says which. Washout is where a clean job goes wrong quietly: nobody sees a bucket of roller rinse go down a storm inlet, and nobody connects it to the notice that arrives months later. The failures this prevents are a driveway rinse that reaches a storm drain and becomes a discharge to surface water, a crew tipping solvent-bearing wash into a customer's utility sink on a septic system, and a drum at the shop that became hazardous waste in its entirety because somebody poured a quart of thinner into the latex.

Scope

Segregation, characterization, on-site handling and off-site routing of the waste streams a residential and small commercial painting job produces: roller and brush washout, sprayer flush, leftover product, solvent-contaminated solids, and empty containers.

It does not cover storage and fire control of the solvent itself before it becomes waste (see the solvent and rag storage and fire control standard, which owns the oily-rag route and the container rules), sprayer flush procedure (see the airless sprayer standard), or lead-bearing debris on an RRP job, which the RRP containment standard governs and which routes differently.

Procedure

1. Set up four labeled streams before the first cleanup, not after. Stage separate containers for usable leftover product, waterborne washout and solids, solvent-bearing liquids and solvent-contaminated solids, and empty containers. Acceptance: four labeled containers present and lidded on site before the first brush is cleaned, each label naming the stream in words. Wrong, and the stop rule: a quart of thinner poured into a latex washout drum makes the whole drum a solvent-bearing waste, so a stream that has been cross-contaminated is relabeled to the more restrictive stream immediately rather than argued about. Hazard: none at staging, and it is a step because mixing is the cheapest way to multiply a shop's disposal obligation.

2. Characterize each stream in writing, from the safety data sheet and the rules that actually bind you. Read the sheet for each product in the stream, then check your state and local rules, which are frequently stricter than the federal floor. Acceptance: a written determination per stream naming the sheet section relied on, the state or local rule checked, and the shop's generator category, since 40 CFR 262.14 sets the very small quantity generator category at or below 100 kg of hazardous waste per calendar month and an authorized state program may set it lower. Wrong, and the stop rule: an unidentified liquid is handled as the most restrictive stream until it is identified, and a stream with no determination on file does not get picked up on a phone call. Hazard: none, a desk determination, and it is the step that decides everything below, since solvent-bearing wash is typically an ignitable characteristic waste under 40 CFR 261.21 while waterborne wash usually is not.

3. Keep every drop out of the storm system, the street and the ground. Site the washout station on a contained surface away from any inlet, check which way the site drains before you set it, and protect the nearest inlet before any rinsing starts. Acceptance: zero rinse water outside the station, the nearest storm inlet identified in the job note with its distance, and an inlet cover or berm in place when the station is within one slope-length uphill of it. Wrong, and the stop rule: a rinse on a driveway that reaches the gutter is a discharge, so a spill heading for an inlet is bermed and absorbed first, the inlet is protected, and the office is told the same hour rather than at week's end. Hazard: wash water carries the coating's biocides and its alkalinity, so gloves and eye protection go on for rinsing and any splash to the eye takes a 15 minute flush and medical attention.

4. Route waterborne washout to a permitted destination, confirmed by the authority in writing, and never assume a drain. Rinse into the station, let the solids settle, and route the liquid only where the sewer authority permits it. Acceptance: a written statement from the local sewer utility or authority on file naming what the shop may discharge to the sanitary sewer, and the day's washout routed to that destination or hauled. Wrong, and the stop rule: a house on a septic system takes no washout at any drain, ever, so on septic the entire volume goes into the station and off site, and if the utility's position is not on file the load is hauled rather than poured. Hazard: carrying a full tub is a lifting and splash hazard, so it is moved with two people or drawn down into smaller containers first, and never carried through the occupied part of a house.

5. Run solvent cleanup closed-loop, into a closed labeled container. Flush into a closed metal container, let the pigment settle, decant and reuse the clear layer for the next flush, and treat the sludge as solvent-bearing waste. Acceptance: the container closed except while adding, labeled with the words describing the waste and the accumulation start date, and stored per the solvent standard's container rules. Wrong, and the stop rule: an open pail of dirty thinner in a van is both a vapor source and an uncontrolled waste, so an unlabeled or unlidded container is corrected before the truck moves. Hazard: every transfer into this container is a solvent transfer, so it is bonded metal to metal, done outdoors or in the ventilated area, away from ignition sources, exactly as the solvent standard requires; and if the container is found warm or swollen, it goes to open ground away from the structure and the vehicle immediately and the shop is told.

6. Deal with leftover product before it becomes waste at all. Offer usable leftover to the customer labeled with product, sheen, color and the rooms it covers, and handle what nobody wants under the local rule for latex, which in many jurisdictions permits solidified latex in ordinary trash and in others does not. Acceptance: every can left with the customer labeled per the shop's HazCom labeling standard, and every can taken away entered against its stream with an approximate volume. Wrong, and the stop rule: a half-full can with no label is neither a touch-up kit nor a disposable, so an unlabeled can is labeled or it leaves as waste. Hazard: solidifier and dried latex generate dust when disturbed, so hardened material is not sanded, broken up or dumped from height, and the container is closed while it dries out of reach of children and pets.

7. Track the clock and the volume at the shop, then move it out on a documented pickup. Log each container's accumulation start date and running volume, keep incompatible streams separated, and schedule pickup with a permitted hauler or a household or small-business collection event where your generator category allows it. Acceptance: every accumulation container closed, labeled and dated, the shop's monthly hazardous waste total tracked against its generator category, and a receipt or manifest on file for every load that leaves. Wrong, and the stop rule: a container sitting past the limit your generator category allows is a violation that grows quietly, so the office schedules pickup at a threshold below the limit rather than at it. Hazard: loading drums is a lifting and spill hazard, so drums move on a cart or a dolly, lids are latched before movement, and nothing gets loaded into a passenger vehicle.

The record this produces

Per job: the four-stream setup note, the nearest storm inlet and its distance, the volume of each stream generated, any spill and what was done, and what was left with the customer. Per shop: the written characterization per stream, the utility's written position on sanitary sewer discharge, the generator category determination, container accumulation start dates and volumes, and every pickup receipt or manifest. The utility letter is what the crew reads instead of guessing at a sink, and the manifests are what an inspector asks for first.

One run of this procedure, filled in

Exterior body coat in waterborne acrylic plus oil-based primer on trim, one house, three days, two painters. The property is on a septic system with a storm inlet at the kerb. Step 1: four containers staged in the driveway before cleanup on day one. Step 2: the acrylic wash characterized as non-hazardous under the federal rule with the state rule checked and noted, the oil primer's flush characterized as ignitable under 40 CFR 261.21, the shop's category confirmed as a very small quantity generator against the 100 kg per calendar month figure at 40 CFR 262.14.

Step 3: the storm inlet measured 18 ft from the intended washout position and downhill of it, so the station moved to the back slab and an inlet cover went on anyway. Step 4 fails. The plan on day one had been to take the acrylic rinse to the utility sink in the garage, which the crew had done on the last two jobs in that neighborhood. The property is on septic, so the step's stop rule fired outright: nothing went to a drain. The full volume stayed in the station, roughly 4 gallons on day one and 3 gallons on day two, or about 7 gallons across the two rinsing days, and it was hauled to the shop and held for the scheduled pickup. The lead logged the event, and the office added the septic question to the pre-job checklist that afternoon, because the same crew had made the same assumption twice.

Step 5: primer flush into a closed metal container labeled with its contents and an accumulation start date, decanted after settling on day three and the clear layer reused for the final brush cleaning, sludge held as ignitable waste. Step 6: one gallon of acrylic left with the customer labeled with product, sheen, color and the elevations it covers; a half-gallon of primer taken away and entered against its stream. Step 7: containers closed, dated and separated at the shop, pickup scheduled at the shop's own threshold, receipt filed against the job.
