Neighbor Property Line Encroachment During Framing Response
Purpose
A setback measured from a fence at footing layout, or a plat re-read at the permit counter, is a working assumption until a licensed surveyor sets a pin. Framing is where that assumption gets tested: the posts are up, the beam reads square to the house, and a neighbor leans over a hedge to say the new deck looks like it sits on their side of the old fence line, or a fresh survey ordered for something unrelated puts the boundary somewhere the layout never accounted for. What happens in the next hour decides whether this becomes a documented, surveyed resolution or a dispute that outlives both current owners. This procedure guarantees nobody on the crew argues a property line in the yard, the standing structure is protected rather than torn out or built past the question, and the resolution is verified by survey and recorded, not settled by whoever spoke last.
Scope
Covers discovery of a suspected or confirmed boundary, easement, or setback problem once posts or framing are standing, through a surveyed resolution and reauthorization to continue. Applies regardless of who raises the question, the neighbor, a permit reviewer, a title survey, or the crew's own second look.
Does not cover the setback check deckbuilding-footing-layout-and-inspection-readiness performs at the footing stage; this procedure exists for the case where that step's reference point turns out wrong or contested. Does not cover framing technique or connection quality, which deckbuilding-post-and-beam-framing-standard owns unchanged. Does not resolve the legal boundary itself or what a neighbor's signature on an agreement binds; those are a licensed surveyor's and an attorney's questions, not the crew's.

Procedure
1. Stop work at the questioned corner or side only, the moment a credible boundary question arises, and keep the rest of the job moving where unaffected. Acceptance: framing halted within the zone the question touches, work continuing elsewhere on the deck. Wrong looks like shutting the whole job down over a question that affects one corner, or the opposite, continuing to frame the questioned corner while sorting it out. Stop rule: any credible question, raised by the neighbor, a reviewer, or a survey document, halts further framing at that location until step 3 resolves it. Hazard: none in stopping; the exposure in this procedure is what gets said and built next, not a live physical danger.
2. Redirect any conversation with the neighbor to getting a licensed survey, and do not measure, argue, or agree to anything about the line on site. Acceptance: the crew's only substantive response is a commitment to a survey and a promise the office will follow up. Wrong looks like a lead pulling a tape to settle it right now, which commits the shop to a fence-to-fence measurement that carries no legal weight and may have to be walked back once a real survey contradicts it. Stop rule: any crew member who finds themselves negotiating a remedy with the neighbor stops immediately and refers it to the office. Hazard: none physical; the risk here is verbal and it is the shop's exposure, not a body's.
3. Order a licensed survey with pins or stakes physically set in the ground, not a plat map re-read at a desk. Acceptance: a licensed surveyor's staked result on site, with a signed plat or survey document. Wrong looks like accepting the original permit-stage plat re-read as sufficient once the question is contested. Stop rule: framing at the affected location does not resume until the staked survey exists, however confident anyone is about the original layout. Hazard: none.
4. Run the extended-pause securing procedure on the standing structure rather than assuming routine active-work bracing covers a multi-day wait. Follow deckbuilding-weather-hold-and-partial-completion-standard's bracing and barricade steps for the affected frame, since a boundary pause carries the same risk that procedure controls for: a partially built structure standing longer than its temporary bracing and lack of guards were sized for. Acceptance: that procedure's securing checklist completed and confirmed for the affected frame, dated. Wrong looks like leaving the bracing as it was mid-sequence because it's just waiting on paperwork. Stop rule: nobody treats the pause as over until that procedure's own reverification step has run. Hazard: an unbraced or unguarded frame left standing through an open-ended pause carries the same fall and racking hazards a weather hold controls for, whatever the trigger.
5. Compare the staked survey to the as-built framing position with your own measurement, and write down the actual distance, whether it shows clearance or encroachment. Acceptance: a measured distance from the surveyed pin to the nearest framing member, in writing, with a sketch. Wrong looks like eyeballing close enough once the stakes are in, the same judgment that got the job here. Stop rule: any measured encroachment, however small, is reported rather than judged immaterial on site; materiality is the permit office's or an attorney's call. Hazard: none.
6. Notify the permit office if the jurisdiction requires disclosure once an encroachment is confirmed. Requirements and triggers vary by jurisdiction; the office confirms with the local building department rather than assuming either way. Acceptance: a written record of the inquiry and the answer, whether or not disclosure was ultimately required. Wrong looks like deciding unilaterally that a small encroachment is not worth mentioning. Stop rule: an encroachment confirmed to require disclosure is disclosed before framing resumes at that location. Hazard: none.
7. Choose a remedy path once the survey and any required disclosure are complete, and route each option to the party who owns it. Relocating the framing goes back through the designer, the same span and spacing reconfirmation any redesign requires. A negotiated setback variance or written encroachment agreement goes through the business owner and, where disputed, an attorney; what a signed agreement actually binds is that attorney's question, not the shop's to state as settled. Removing and rebuilding the section reenters the framing standard from its own step 1. Acceptance: one chosen path, documented, with the owning party's sign-off. Wrong looks like the crew picking a path on site because it looks fastest. Stop rule: no framing resumes until the chosen path has documented approval. 8. Price and authorize the remedy through the change order protocol before any work proceeds on it. Acceptance: a written authorization from the customer covering the schedule and scope impact of the chosen path. Wrong looks like starting a relocation or rebuild on a verbal go-ahead. Stop rule: no authorization, no work at the affected location; the crew continues on unaffected parts of the job. Hazard: none.
9. Get the permit office's sign-off on the corrected position before framing continues there. Acceptance: an approved revision on record, a field note or a formal amendment depending on the scale of the change. Wrong looks like assuming the original framing inspection still covers a relocated corner. Stop rule: no sign-off, no continued framing at that location. Hazard: none.
10. Resume framing on the corrected layout and re-run square and plumb checks, treating the corrected section as new work rather than a continuation of what stood before the pause. Acceptance: diagonals and plumb readings taken fresh on the corrected section, not assumed carried over. Wrong looks like resuming mid-sequence as if nothing happened. Stop rule: the framing inspection is called again for the corrected section if the original inspection did not cover the new position. Hazard: same hazards the framing standard already names for active work at height; nothing here changes those.
The record this produces
One Boundary Question Record per event: how and when the question arose; the staked survey document; the measured comparison and its result; the disclosure inquiry and answer; the chosen remedy path and its sign-off; the change order authorization; the permit sign-off on the corrected position; and the resumption date.
The office reads it if the neighbor relationship resurfaces at a later sale. The estimator reads it before bidding another job on that street, since a boundary contested once is worth asking about before the next job's layout.
Worked pass, including the stop that fired
A 16 by 22 ft attached deck, posts and beam already up, three days from the framing inspection call.
Step 1 fired when the neighbor, walking her dog, said the new posts looked closer to her fence than the old deck's ever were. The lead halted framing on that side only; the far side kept moving. Step 2 held: the lead thanked her, said the shop would confirm the line with a survey, and did not pull a tape to check right now, the instinct in the moment.
Step 3 ordered a licensed survey, staked within four working days. The stakes landed 14 inches inside the original fence line, meaning the fence, used as the setback reference at footing layout, was not the true boundary. Step 4 reverified bracing on the affected two-post run, adding a second direction that had been adequate for active work but not for a week standing idle.
Step 5 measured the framing against the new stakes: the nearest post sat 6 inches into the required setback, a real encroachment. Step 6's inquiry found the jurisdiction requires written disclosure of a discovered setback violation before continuing; the office filed it.
Step 7 is where the stop fired against the crew's first instinct. The initial read was that relocating the one post would be fastest, but the designer found that moving it 8 inches would shift the beam's bearing enough to require rechecking the span table, and the corrected spacing left an unequal bay the beam did not cover without a fourth post. When the site does not match this procedure
If the neighbor is hostile or will not allow the surveyor onto their side to confirm a shared pin, the survey still proceeds from the accessible side and the office documents the refusal; framing stays halted at that location regardless. If the encroachment is small enough that a variance seems obviously available, do not treat obviously available as a decision; the attorney and the AHJ still make that call, and the crew's role stays the same either way, wait for the documented path.
